Terms of Service
These Terms of Service (hereinafter referred to as "these Terms") stipulate the conditions for using the services (hereinafter referred to as "the Service") provided by Nanami Chino (hereinafter referred to as "the Provider") on this website. Users (hereinafter referred to as "Users") are required to use the Service in accordance with these Terms.
Article 1 (Application)
These Terms shall apply to all relationships between Users and the Provider regarding the use of the Service.
The Provider may establish various regulations (hereinafter referred to as "Individual Provisions") in addition to these Terms regarding the use of the Service. Regardless of their names, these Individual Provisions shall constitute a part of these Terms.
In the event of any inconsistency between the provisions of these Terms and the Individual Provisions of the preceding article, unless otherwise specified in the Individual Provisions, the provisions of the Individual Provisions shall take precedence.
Article 2 (User Registration)
In the Service, registration applicants shall apply for user registration by agreeing to these Terms and following the methods specified by the Provider, and user registration shall be completed upon approval by the Provider.
The Provider may not approve the application for user registration if the following reasons are deemed to exist, and shall not be obliged to disclose the reasons for such non-approval:
- In the event of false statements in the application for user registration
- In the event of a past violation of these Terms
- In other cases where the Provider deems the user registration to be inappropriate
Article 3 (Management of User ID and Password)
Users shall be responsible for appropriately managing their user ID and password for the Service.
Users shall not transfer or lend their user ID and password to third parties, nor share them with third parties.
If the combination of a user ID and password matches the registration information and is logged in, the Provider shall regard it as the user's own use.
Except in cases where the Provider is intentionally or grossly negligent, the Provider shall not be liable for any damages resulting from the use of a user ID and password by a third party.
Article 4 (Usage Fees and Payment Methods)
Users shall pay the usage fees displayed on this website by the method specified by the Provider as the consideration for the paid portion of the Service.
In the event of delayed payment of the usage fees, the User shall pay a delay damages fee at the rate of 14.6% per annum.
Article 5 (Prohibited Acts)
Users shall not engage in the following acts when using the Service: - Acts that violate laws or public morals - Acts related to criminal activities - Acts that infringe upon copyrights, trademark rights, or other intellectual property rights included in the content of the Service - Acts that destroy or interfere with the functions of the servers or networks of the Provider, other users, or third parties - Acts of commercial use of information obtained through the Service - Acts that obstruct the operation of the Provider's services - Unauthorized access or attempted unauthorized access - Collection or accumulation of personal information of other users - Acts of using the Service for fraudulent purposes - Acts that cause disadvantages, damages, or discomfort to other users or third parties - Impersonation of other users - Advertisement, solicitation, or business activities on the Service without the Provider's permission - Acts aimed at meeting unfamiliar individuals of the opposite sex - Indirect or direct provision of benefits to antisocial forces in relation to the Provider's services - Other acts deemed inappropriate by the Provider
Article 6 (Suspension of Service Provision, etc.)
If the Provider determines that any of the following reasons exist, the Provider may suspend or interrupt all or part of the provision of the Service without prior notice to the User: - When performing maintenance or updates on the computer system for the Service - When the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters - When the computer or communication lines are stopped due to accidents - When the Provider deems the provision of the Service to be difficult for any other reason The Provider shall not be liable for any disadvantages or damages incurred by the User or a third party due to the suspension or interruption of the provision of the Service.
Article 7 (Restriction of Use and Deletion of Registration)
If the User falls under any of the following items, the Provider may, without prior notice, restrict all or part of the use of the Service or delete the User's registration: - In the event of a violation of any provision of these Terms - In the event that false information is found in the registered information - In the event of non-performance of payment obligations such as fees - In the event of no response to communication from the Provider for a certain period of time - In the event of no use of the Service for a certain period of time after the last use - In other cases where the Provider deems the use of the Service to be inappropriate The Provider shall not be liable for any damages incurred by the User as a result of the actions taken by the Provider based on this article.
Article 8 (Withdrawal)
Users may withdraw from the Service through the withdrawal procedure specified by the Provider.
Article 9 (Disclaimer of Warranty and Disclaimer)
The Provider does not explicitly or implicitly guarantee that the Service is free from defects (including defects in safety, reliability, accuracy, completeness, effectiveness, suitability for specific purposes, security, errors, bugs, or infringement of rights).
Except in cases of intentional or gross negligence by the Provider, the Provider shall not be liable for any damages incurred by the User due to the Service. However, this disclaimer shall not apply if the contract between the Provider and the User regarding the Service (including these Terms) constitutes a consumer contract under the Consumer Contract Act.
Even in cases set forth in the proviso of the preceding paragraph, the Provider shall not be liable for any damages incurred by the User due to the Provider's non-performance of obligations or torts caused by the Provider's negligence (excluding gross negligence). In addition, the compensation for damages incurred by the User due to the Provider's non-performance of obligations or torts caused by the Provider's negligence (excluding gross negligence) shall be limited to the amount of the usage fees received by the Provider in the month in which the damages occurred.
The Provider shall not be liable for any transactions, communications, or disputes between the User and other users or third parties regarding the Service.
Article 10 (Changes to the Service Content, etc.)
The Provider may change, add, or discontinue the content of the Service with prior notice to the User, and the User shall accept this.
Article 11 (Amendment of the Terms of Service)
The Provider may amend these Terms without the individual consent of the User in the following cases: - When the amendment to these Terms conforms to the general interests of Users - When the amendment to these Terms does not contravene the purpose of the Service usage agreement and is reasonable in light of the necessity of the amendment, the adequacy of the content after the amendment, and other circumstances related to the amendment The Provider shall notify the User in advance of the amendment to these Terms, the content of the amended Terms, and the effective date of the amendment.
Article 12 (Handling of Personal Information)
The Provider shall handle personal information obtained through the use of the Service appropriately in accordance with the Provider's Privacy Policy.
Article 13 (Notification or Contact)
Notifications or contacts between the User and the Provider shall be made in the manner specified by the Provider. The Provider shall deem the currently registered contact information as valid unless the User has notified a change in accordance with the method separately specified by the Provider, and notifications or contacts shall be deemed to have been delivered to the User at the time of transmission.
Article 14 (Prohibition of Assignment of Rights and Obligations)
Users shall not assign or pledge to third parties their position under the usage agreement or the rights or obligations based on these Terms without the prior written consent of the Provider.
Article 15 (Governing Law and Jurisdiction)
- These Terms shall be governed by Japanese law.
- In the event of a dispute regarding the Service, the court having jurisdiction over the location of the Provider's head office shall have exclusive jurisdiction.
